Finally, victims of Child Sexual abuse who were locked out of the courts because they were outside the Statute of Limitation period, can now, under the newly enacted Child Victims Act, get justice and redress.
The New York Child Victims Act key components are:
-One year window to file claims from August 14, 2019, through August 14, 2020
-actionable misconduct includes sexual assaults and negligence
-the new age cutoff for filing sex abuse claims (after the window ) is 55
-the notice of claim requirement (for municipal defendants) is removed within the one year window.
